Abstract
The need for care arising from a child’s temporary illness may give rise to a conflict between a working parent’s duty of care and supervision under family law and their obligation to perform work under their employment contract. This conflict raises, on the one hand, the question of whether the parent may be temporarily exempted from the obligation to work in order to care for the child and, on the other, how any resulting loss of wages or income should be compensated. This study examines the issue in light of the best interests of the child, the protection of the child’s care needs, and the parent’s duty of care, and assesses the legal consequences of taking time away from work due to a child’s temporary illness under labour and social security law. The German legal framework is analysed from a comparative law perspective, with particular attention to Sections 275/3 and 616 of the German Civil Code (BGB) and Section 45 of Book V of the German Social Code (SGB V), which specifically provides for exemption from the obligation to work due to a child’s illness and compensation for the resulting loss of income. In particular, the exemption from the obligation to work under Section 45 SGB V and the income protection provided through child sickness benefit are considered a functional model for Turkish law. On this basis, the adequacy of the existing protection under Turkish law is assessed, and the elements of a possible protective framework that could be developed with reference to German law are discussed.
