Abstract

One of the fundamental problems that has brought modern penal enforcement systems to an impasse is the excessive overcrowding of correctional facilities. In response to this problem, almost every country has introduced various institutions that serve as alternatives to conventional imprisonment. One such alternative offered by technological advances is electronic monitoring. First implemented in the United States, this method subsequently became a widely used means of supervision throughout the world. Today, it can be observed that different electronic systems are being employed in various areas of criminal law. In addition to conventional methods that enable the monitoring of the location of the person subject to supervision, alternative systems have also been developed with the aim of preventing violence against women and controlling alcohol consumption. Although the areas of application of these systems continue to expand, debates regarding their advantages and disadvantages are still ongoing. It has also been argued that electronic monitoring, which has emerged as an important alternative, does not provide benefits to the extent claimed by its proponents. Various criticisms have been directed at this technological system on the grounds that it may stigmatize offenders and impose restrictions on fundamental rights and freedoms. The primary aim of this study is to provide basic information on electronic monitoring and subsequently examine these arguments advanced against the method.
