Abstract

The sexual exploitation and abuse of children remain among the gravest crimes confronting humanity, demanding resolute action at the international level. Combating these crimes requires a strong global dimension. The cross-border nature of such offenses has grown increasingly complex with technological advancements, rendering national legislative responses inadequate and insufficient. Consequently, numerous efforts have been undertaken at both global and regional levels. Yet a binding instrument that addresses the problem comprehensively, covers all its dimensions, and is equipped with a monitoring mechanism to oversee implementation became possible for the first time with the adoption of the Lanzarote Convention by the Council of Europe in 2011. This study first examines the international instruments in force prior to the Lanzarote Convention, the congresses held, and the work carried out in Europe in the fight against the sexual exploitation and abuse of children. It then evaluates the new framework introduced by the Lanzarote Convention and explains its dynamic and distinctive structure. Finally, the international cooperation dimension, which is intrinsically linked to the Convention as a whole, is addressed. The emphasis placed on international cooperation constitutes one of the Convention's greatest strengths. Rather than treating international cooperation as a secondary heading confined to mutual legal assistance and extradition, the Lanzarote Convention establishes it as a multi-actor mechanism interconnected with the substantive provisions of the instrument. In this context, the study concludes that the Lanzarote Convention is the most comprehensive and institutionalized international legal instrument in the fight against the sexual exploitation and abuse of children, while also demonstrating that the success of the approach it establishes depends on the political will and implementation capacity of the States Parties.
