Abstract

This article explores the conflict between the right to be forgotten—a legal safeguard that has taken shape in response to the indefinite digital preservation of personal information—and the freedoms of expression and the press, which are indispensable to the functioning of open democratic societies. After tracing the conceptual origins, historical trajectory, and normative underpinnings of the right to be forgotten, the article examines why press freedom and the archival role of digital media deserve robust protection. The closing section draws on the jurisprudence of the Court of Justice of the European Union, the European Court of Human Rights, and the Turkish Constitutional Court to determine how an equitable reconciliation of these competing values can be achieved in practice. Building on this comparative analysis, the article proposes actionable balancing benchmarks—anchored in the individual’s public or private standing, the erosion of informational relevance over time, and the proportionality of any remedial measure—and puts forward policy recommendations for Turkey covering legislative reform, administrative specialisation, and the drafting of a judicial balancing guide.
