Ride-sharing platforms like Uber and automotive companies such as Tesla, which offer vehicles featuring autonomous driving systems, have played a significant role in advancing autonomous vehicle technology.. Parallel to these developments, autonomous vehicle accidents have also become problems that need to be solved. In particular, questions such as who is responsible in accidents involving autonomous vehicles and whether the driver or another person is considered the operator of these vehicles in insurance law are occupying doctrine and judicial practice. This study will attempt to answer questions regarding the concepts of autonomy and autonomy, how autonomous vehicles are classified, and who bears legal responsibility in insurance law, specifically regarding the status of the vehicle operator in autonomous vehicles. Otonom araçlar, yapay zekanın yaygınlaşması ile gündelik hayatta, geleneksel araçlara kıyasla halen az sayıda olsa da, önemli oranda kullanılır hale gelmiştir. Özellikle paylaşımlı yolculuk esasına dayanan Uber gibi platformlar, yine kendi sattığı araçlar da otonom sürüş imkanlarını getiren Tesla ve benzeri şirketler otonom araç ve otonom sürüş konusunda oldukça gelişme kaydetmiştir. Bu gelişmelere paralel olarak otonom araç kazaları da çözümlenmesi gerekli birer hukuki sorun haline gelmiştir. Özellikle otonom araçların karıştığı kazalarda sorumluluğun kime ait olduğu, sigorta hukuk özelinde bu araçlarda sürücünün mü yoksa bir başka kişinin mi işleten sıfatını haiz olacağı gibi sorular doktrin ve yargı uygulamasını meşgul etmektedir. İşbu çalışmada otonom ve otonomi kavramları, otonom araçların nasıl sınıflandırıldığı ve otonom araçlarda araç işleten sıfatının dolayısıyla sigorta hukuku özelinde hukuki sorumluluğun kime ait olduğu sorunları cevaplanmaya çalışılacaktır. Bu noktada mukayeseli hukuktaki yasama faaliyetlerine, mevcut kazalara ilişkin yargısal kararlara ve Türk hukuku açısından değerlendirme yapılmaya gayret edilmiştir.
