Abstract
Social media platforms are among the primary digital spaces where individuals can easily convey their opinions to large audiences. While the ability to use these platforms anonymously is considered a significant development in terms of freedom of expression, it also creates serious legal problems in terms of protecting personal rights and determining legal responsibility. The fact that users who create content without using their real identities can be more aggressive and uncontrolled in their posts compared to posts made with their real identities increases the number of personal rights violations originating from social media. When the difficulty of identifying the content provider and thus determining their legal responsibility in cases where fake social media accounts are used is added, the resulting victimizations bring about a number of new legal problems. While legal violations arising from the use of social media have previously been discussed within the context of freedom of expression and personal rights, studies focusing specifically on the role and complicating effect of fake social media accounts in these violations have been limited. This study aims to evaluate the violations of personal rights stemming from the use of fake social media accounts and the resulting legal liability within the framework of Turkish civil law. Accordingly, the study categorizes fake social media accounts into two distinct categories: accounts impersonating a specific real person, and accounts created anonymously or using pseudonyms. This distinction is not previously established in the existing literature; however, it is considered to have significant consequences in terms of legal liability. This study concludes that current legislation and the practices of social media platforms are insufficient in legally defining and classifying fake social media accounts, preventing violations of personal rights arising from this area, and remedying the resulting damages. Therefore, emphasis is placed on the need for a specific and systematic regulation that clearly defines the legal nature of fake social media accounts and the tort liability related to violations of personal rights that may arise from their use, as well as the conditions and criteria for this legal liability, thereby establishing a balance between freedom of expression and violations of personal rights.
