Abstract
This study examines the enforcement and supervisory regime of the European Union Artificial Intelligence Act (AI Act) within the framework of a risk-based governance approach. It first analyzes the AI Act’s definition of artificial intelligence systems, its risk-classification framework, and the specific provisions governing general-purpose artificial intelligence (GPAI) models. The study subsequently evaluates the hybrid governance structure established under the AI Act. In this context, the roles and powers of the European Commission, the AI Office, the European AI Board, the Scientific Panel of Independent Experts, and national market surveillance authorities, together with the legal and institutional limits arising from such powers and competences, are assessed collectively. The article argues that the AI Act is not merely a technical regulatory instrument. Rather, beyond its regulatory and supervisory functions, it establishes a functional regulatory model with global implications that integrates fundamental rights protection, digital governance, market oversight, and enforcement law into a comprehensive normative framework. Within this context, the obligations imposed on GPAI providers, conformity assessment mechanisms, market surveillance procedures, and enforcement processes are examined in detail. The study further evaluates the ongoing reform debates within the European Union in light of the proposed Digital Omnibus Regulation. Ultimately, the article argues that the enforcement architecture of the AI Act occupies a central position within the European Union’s digital governance ecosystem and may generate significant normative implications for the future development of global AI governance.
