Abstract

This article analyses the European Union Artificial Intelligence Act’s transformation of artificial intelligence literacy into a binding normative obligation for the first time, with a particular focus on artificial intelligence applications used in the fields of law and the judiciary. The risk-based approach adopted by the Act moves the regulation of artificial intelligence beyond a narrowly defined technical safety framework and situates it within a preventive governance model integrated with the protection of fundamental rights, human oversight, and institutional accountability. Within this framework, the study argues that artificial intelligence literacy should not be regarded merely as a supportive policy preference, but rather as a normative instrument that ensures the effective functioning of the regulatory system before risks materialise. In particular, the effective implementation of the obligations envisaged for judicial and legal artificial intelligence systems classified as high-risk under Annex III of the Act depends on the critical assessment capacity of the relevant actors and their ability to distinguish risks according to the manner in which artificial intelligence systems are used. The article further discusses that, due to the Act’s extraterritorial effects, this obligation relating to artificial intelligence literacy also produces significant consequences for countries outside the EU that nevertheless maintain intense legal and digital interaction with the Union. In this respect, the study contends that the institutionalisation of artificial intelligence literacy as a soft-law-based governance mechanism in Türkiye during the pre-legislative phase may play a preparatory role for binding regulations that may be adopted in the future.
