Abstract
From a geographical perspective, the two most significant political events of the 20th century were World War II (1940-1944) and the disintegration of the Communist Bloc (Combloc) that began in 1989. These developments not only reshaped national geographies and world politics but also accelerated the growth of global trade. Consequently, the demand for goods and services increased among societies in different geographical areas; and with the emergence of new systems for marketing goods, the creation of technical and legal regulations concerning international trade became essential. In this context, the Convention on the Contract for the International Carriage of Goods by Road (CMR) was prepared in 1956 by the United Nations Economic Commission for Europe (UNECE) with the aim of resolving problems arising from international goods transportation with uniform rules. The regional security problems arising from the Russo-Ukrainian War and the conflicts between the US, Israel, and Iran have necessitated a reassessment of the CMR approach, which links the carrier's exemption from liability to unavoidable circumstances, in light of today's complex security conditions. The article, using a method of literature review and interpretation, can be summarized as follows: the legal nature of the carrier's liability for delay is a mitigated form of strict liability under the CMR; the burden of proof for grounds for exemption from liability, as stipulated in CMR Article 17/II, rests with the carrier; and the amount of the carrier's liability for delay is limited to the carriage fee, in accordance with CMR Article 23/V, except for the exceptions provided for in the agreement.
Bu çerçevede, uluslararası eşya taşımacılığından doğan sorunların yeknesak kurallarla çözülmesi amacıyla, “Eşyaların Karayolundan Uluslararası Nakliyatı için Mukavele Sözleşmesi” (Convention on the Contract for the International Carriage of Goods by Road – CMR), 1956 yılında Birleşmiş Milletler Avrupa Ekonomik Komisyonu (UNECE) tarafından hazırlanmıştır. Rusya-Ukrayna Savaşı ile ABD-İsrail ve İran arasındaki çatışmaların ortaya çıkardığı bölgesel güvenlik sorunları, taşıyıcının sorumluluktan kurtulmasını kaçınılması ve sonuçlarının önlenmesi mümkün olmayan hâllere bağlayan CMR yaklaşımının, günümüzün karmaşık güvenlik koşulları bakımından yeniden değerlendirilmesini gerekli kılmıştır. Çalışmada kaynak tarama ve yorumlama yöntemleri kullanılarak; taşıyıcının gecikmeden doğan sorumluluğunun CMR kapsamında hafifletilmiş kusursuz sorumluluk niteliğinde olduğu, CMR m. 17/2’de düzenlenen sorumluluktan kurtulma nedenlerinin ispat yükünün taşıyıcıya ait bulunduğu ve gecikmeden doğan sorumluluğun, antlaşmada öngörülen istisnalar saklı kalmak üzere, CMR m. 23/5 uyarınca taşıma ücretiyle sınırlı olduğu sonucuna ulaşılmıştır.
