Abstract
The right of pre-emption is a newly established right that grants the holder of a pre-emption right the authority to become the buyer of a jointly owned property if the owner sells their share in the property to a third party, as a result of a lawsuit they file. Turkish law recognizes two principal forms of pre-emption: Contractual pre-emption, which arises from an agreement between the parties, creates a personal claim, and may be rendered effective erga omnes through annotation in the land registry; and legal right of pre-emption, which is inherent to co-ownership by shares and is regulated under Articles 732–734 of the Turkish Civil Code. The 11th Judicial Reform Package introduced significant amendments to legal right of pre-emption regime, notably with respect to the method of exercise, limitation periods, and issues surrounding the determination of the purchase price once litigation is commenced. Given the considerable caseload associated with legal right of pre-emption in practice, the legislature’s decision to extend the applicability of these changes to pending proceedings warrants particular scrutiny. The stipulation that these amendments concerning the statutory right of pre-emption, which has a significant workload in practice, shall also apply to pending cases, is established by law, it is an important issue that must be carefully examined that, pursuant to the relevant provision, a revaluation of the property's value will also be carried out with respect to cases filed before the law entered into force, including those pending before a higher appellate court and having reached the decision stage. The study examines the relevant amendments and the provisions of Temporary Article 1, and includes recommendations on the subject.
