Abstract

Mining is one of the riskiest investment activities. Operation permission, which is required to start mine production, the EIA decision, and land ownership permits are given to the license holder on condition that business license and work permit (GSM license/permit), and other licenses and permits are obtained. The GSM permit is one of the basic permits required to obtain a mining license. If the required permissions are not obtained as a result of bureaucratic procedures and the prolongation of the process may cause the cancellation of the operating license. Within the scope of the legislation, it is envisaged that all these permits will be given to the mining license holder within 3 months during the EIA process. However, in practice, these permissions are mostly not given during this period. There are different applications in each city regarding GSM license. As a result of these different practices, mining companies can lose their envisaged mining investments, leave their operation areas, or the licenses can be canceled by the administration. In order to prevent mining investors from being aggrieved in this way, the GSM license should be considered within the scope of the EIA permit. In this context, the place of GSM license, which is one of the basic permits for obtaining an operation permit, in the legislation, GSM fee, the sanctions for not obtaining this license, and the effects of the practices of the competent authority for this license on the permit process are explained. Following, the suggestion that this license should be included under the scope of the EIA permit in order to reduce the bureaucratic process during the permit process was discussed.
