Abstract

In modern urbanization processes, urban green spaces are components of urban infrastructure that contribute to quality of life. However, in Turkey, the land-rent pressure created by the construction-oriented growth model threatens the existence of these areas both quantitatively and qualitatively, and legal protection mechanisms remain inadequate in preventing spatial injustices against administrative interventions. This study aims to analyze the legal status defined within the framework of general zoning legislation, primarily Zoning Law No. 3194 and the Spatial Plans Construction Regulation through the theoretical lenses of "legal geography" and "spatial justice" theories. Within the scope of the research, the "equivalent area" mechanism and 45 precedent-setting decisions issued by the Sixth Chamber of the Council of State between 1989-2024 were selected through purposive sampling and systematically examined to evaluate the spatial consequences of the administrative judiciary's interpretation of technical concepts. Findings indicate that beyond quantitative insufficiency, inequalities in distribution create a deep "spatial injustice." The analysis reveals that the concept of "equivalence" in legal texts is often reduced to a mathematical calculation in practice, while spatial parameters such as ecological connectivity and accessibility are ignored. Consequently, to bridge the gap between legal compliance and spatial performance in the protection of green spaces, it is argued that "ecological equivalence" and "spatial justice" criteria must be integrated into the legislation.
