Abstract
Legal interference with property arises when the administration, without physically seizing a property, renders the right to property ineffective through administrative acts or planning decisions. One of the most controversial issues in such cases concerns the determination of the competent judicial jurisdiction. An examination of the case law of high courts reveals a lack of uniformity in this regard. The Court of Jurisdictional Disputes and the Council of State consistently hold that disputes arising from legal interference fall within the jurisdiction of administrative courts, on the grounds that such interference is based on administrative acts. In contrast, the Court of Cassation considers legal interference as a form of expropriation without compensation and concludes that civil courts have jurisdiction. This disparity further places property owners, whose ownership rights have been violated through unlawful expropriation, in an even more difficult position. The prevailing view in legal doctrine likewise supports the jurisdiction of civil courts, without relying on the concept of voie de fait. This study argues that, given the current state of Turkish law, the distinction between legal interference and de facto expropriation has largely lost its relevance in terms of the protection of property rights. Accordingly, it is concluded that disputes arising from legal interference with property should be adjudicated by civil courts.
