Abstract

This study examines the 2025 decision of the Vienna Regional Court, focusing on the parties’ reference to religious norms in an arbitration agreement and the legal limits of such a reference. In the case at hand, the parties agreed that their dispute would be resolved in accordance with the principles of Islamic law, particularly within the framework of “Ahl al-Sunna wa’l-Jamā‘a,” and on the basis of equity. The enforceability of the arbitral award in Austria was subsequently subjected to judicial review, where the court, without examining the merits of the case, limited its review to arbitrability and public policy. The decision is analyzed along three axes: the normative status of religious norms in modern legal systems, the problem of legal certainty, and the limits imposed by public policy. The analysis shows that the court did not treat religious norms as an autonomous system of applicable law, but rather as a limited normative reference grounded in party autonomy; interpreted issues of legal certainty flexibly in favor of party autonomy in arbitration; and directed public policy review not at the content of the norms applied, but at the outcome of the arbitral award.
