Abstract

The concept of positive discrimination, or “affirmative action”, was first used in the early 1960s in the United States. This term was used to describe measures aimed at ending the discrimination that blacks or African Americans had faced for many years and its effects, and to increase their participation in areas such as employment and education, thereby promoting diversity in socio-economic life. Although the concept originated in the United States, the legitimacy of affirmative action remains highly controversial in the United States. U.S. Supreme Court, the United States’s highest judicial body, has fuelled the debate with its rulings. Indeed, the Court first examined affirmative action in 1978 in its decision on affirmative action in university admissions, “Regents of University of California v. Bakke”, and stated that affirmative action is lawful if certain conditions are met. However, in its 2023 decision in “Students for Fair Admissions v. President and Fellows of Harvard College”, which also concerned affirmative action in university admissions, the Court adopted a different approach from its previous precedents and took a stance against affirmative action. This paper examines the decision of “Students for Fair Admissions v. President and Fellows of Harvard College” and its differences from the Court’s previous precedents.

Nitekim Mahkeme, pozitif ayrımcılığı ilk kez 1978 yılında üniversitelere kabul sürecinde pozitif ayrımcılığa ilişkin verdiği “Regents of University of California v. Bakke” kararında incelemiş ve belirli şartları sağladığı takdirde pozitif ayrımcılığın hukuka uygun olduğunu ifade etmiştir. Lakin 2023 yılında verilen ve yine üniversitelere kabul sürecinde pozitif ayrımcılık uygulamalarına ilişkin olan “Students for Fair Admissions v. President and Fellows of Harvard College” kararıyla önceki içtihatlarından farklı bir yaklaşım belirleyerek pozitif ayrımcılığın karşısında bir tavır almıştır.
