Abstract

The most basic function expected from judicial decisions is to convince the parties of the judgment. The writing style or form of the judgments is important both for the satisfaction of the parties to the case and for the legal effect of the judgments. The laws on the Council of State and administrative procedure do not contain any rules on the style and form of judicial decisions. As is known, the Council of State started to operate in 1927 during the republican era and started to issue judicial decisions in the early 1930s. Since these years, a certain procedure has been established in terms of the writing style and form of decisions. Today it continues to be written in the same style and form. During this period of nearly 90 years, significant changes have taken place in the field of law and the judiciary. It is observed that these changes are not reflected in the style and form of judicial decisions. However, it cannot be said that the style and form of writing in the 1930s has remained unchanged. he Council of State's 2018 Guidelines on the drafting of decisions was the first serious development on this issue. In this study, we will discuss the historical process of the formal structure of the decisions of the Council of State, its current status and what it should be. In this context, we will focus on (1) the reference to the legitimacy of the judgments, (2) the issues to be included in the judgments, (3) the sections of the judgments, (4) the way the judgments are written (headings, paragraphs, sentence structure, etc.).
