Abstract
In the enforcement proceedings through attachment specific to bills of exchange, the execution court may decide to annul the enforcement proceedings ex officio, based on the reasons set forth in Article 170/a of the Execution and Bankruptcy Code, which are related to the bill's characterization as a bill of exchange or the creditor's right of enforcement. In order for the enforcement court to annul the enforcement proceeding, the debtor does not have to have filed a complaint based on these grounds; even if the debtor has filed a complaint based on another ground or has objected to the debt or signature, the enforcement court may decide to annul the enforcement proceeding by ex officio considering the aforementioned grounds. However, if the debtor has waived the signature objection or accepted the debt, the court may no longer decide to cancel the proceeding even if the bill is not in the character of a bill of exchange or the creditor does not have the right to executive proceeding. This distinctive structure of the provision is the main reason why we evaluate it in the context of the basic principles governing the law of civil procedure. As it is known, the principle of disposition and the principle of party presentation apply in civil case. The principle of ex officio examination are exceptionally applicable. However, due to its characteristics, Article 170/a of the Execution and Bankruptcy Code seems to be an exceptional provision that does not coincide with the principle of party presentation on the one hand and the principle of ex officio investigation on the other.
