Abstract
Legal aid plays a fundamental role in the realization of the right to seek justice and the right to a fair trial, both of which are guaranteed by the Constitution. This institution, which aims to ensure access to justice for individuals lacking the financial means to cover litigation expenses, was for a long time limited only to natural persons and public-benefit associations and foundations, in accordance with Article 334 of the Code of Civil Procedure (HMK) No. 6100. This situation constituted a serious obstacle to the right of access to court for private law legal entities, such as commercial companies in financial distress, by causing their exclusion from the scope of legal aid. The annulment of the provision of HMK Art. 334/2 by the Constitutional Court's (AYM) decision dated 24/9/2024 and numbered E.2024/78, K.2024/164 has led to a change in approach in this area. This study examines the new legal situation arising from the said annulment decision, particularly in the context of the right of private law legal entities—who are in financial distress and seeking to overcome it through concordat—to benefit from legal aid. The study addresses how the conditions of "partial or total inability to afford litigation expenses" and "the claim not being manifestly unfounded" should be interpreted in the context of the concordat institution for private law legal entities to benefit from legal aid, specifically considering the situation of companies facing cash flow shortages or whose assets are subject to precautionary measures. In this regard, it is aimed to draw a framework for filling the legal gap created by the AYM's decision in a fair and effective manner with de lege ferenda proposals.
