Abstract

Traffic accidents cause approximately 1.19 million deaths and between 20 to 50 million non-fatal injuries worldwide each year. In cases of non-fatal injuries, legal authorities often request the determination of disability rates in affected individuals. The disability rate reflects the loss in an individual’s quality of life and work capacity compared to the pre-accident state. In Turkey, it was reported that a total of 1,314,136 traffic accidents occurred in 2023, of which 235,071 involved fatalities or injuries, and motorcycle riders accounted for 15.5% of all traffic-related deaths. According to the Turkish Traffic Regulation, it is mandatory for both motorcycle riders and passengers to wear helmets. The primary function of a helmet is to reduce the severity of head impacts by distributing the force exerted on the skull, thereby protecting the brain and other vital organs. According to the literature, head injuries contribute to approximately 70–80% of fatal injuries among motorcycle riders and helmet use has been shown to reduce these fatalities by 28% to 73%. In this particular case, in which a disability rate of 80% was assigned, the study aims to address the medico-legal question frequently posed by the courts: “What is the impact of not wearing a helmet on the resulting disability?” The discussion focuses on whether a physician alone is competent to assess this subject and further explores the influence of helmet material, type, and helmet-head compatibility on injury severity, as well as the protective effect of helmet use as an isolated factor.

Özet

Trafik kazaları dünyada her yıl yaklaşık 1,19 milyon kişinin ölümüne, 20 ila 50 milyon kişinin ölümcül olmayan yaralanmalara maruz kalmasına neden olmaktadır.
