Abstract
The concept of regulation has settled at the center of modern administrative law with the evolution of the state’s role from “operatör” to “regulator”. Proceeding from the perspective of economic history ranging from Mercantilism to Neoliberalism, this study examines the theoretical foundations of regulation and its institutional development, particularly within the legal system of the United States (US). Independent Administrative Authorities, characterized as the “fourth branch” in the US, hold a controversial position regarding the separation of powers due to their hybrid structures combining legislative, executive, and judicial powers. The article addresses the constitutional legitimacy of these institutions, the “headless fourth branch” debates, and changing judicial review standards in light of the recent Loper Bright decision. Consequently, by analyzing the sovereignty gap in technical areas such as cyberspace, the necessity of a balance between technical expertise and democratic accountability is emphasized.
