Abstract
Our study discusses how “human rights,” established as a solution to the catastrophes of World War II by the victorious powers, gradually transformed into an unquestionable sanctity within the post-war order. The concept of “human dignity,” presented as the fundamental basis of this sanctity, is problematically portrayed as a universal and timeless principle. In this context, beyond the general issues of defining and justifying the concept, the Universal Declaration of Human Rights’ reference to dignity as a central value—without offering a clear definition—emerges as a significant source of ambiguity and a fundamental problem in the justification of human rights. In positive law, human dignity becomes visible both through the state's obligation of non-interference and its responsibility for socio-economic protection. From this perspective, drawing on the lines of Marx, Burke, and Schmitt, our study highlights the ideological and depoliticizing function of abstract rhetoric on dignity and rights, emphasizing how the so-called “overlapping consensus” often devolves into a Western-centric universalist narrative.
