Abstract

Kazakhstan, whose energy economy has traditionally relied on abundant fossil fuel reserves, has recently undergone, a comprehensive legal transformation toward renewable energy development in response to global climate commitments and energy security concerns. This study analyzes Kazakhstan’s national renewable energy legislation developed within the framework of the “Green Economy Transition” strategy and examines the effectiveness of these regulations in practice. Using a policy and document analysis approach, the research evaluates legal provisions, policy instruments, and institutional practices within renewable energy sector. In particular, the study investigates the legal and economic implications of the transition from feed-in tariffs to competitive auction mechanisms, as well as the influence of international cooperation on national legislation. The findings indicate that although Kazakhstan has made significant progress in developing legal frameworks to promote renewable energy investments, structural challenges-such as limitations in electricity grid infrastructure, financial risks, and the fossil fuel-dependent structure of the energy system-continue to constrain the pace of the energy transition. The study identifies areas for regulatory improvement within the existing legal framework and provides policy recommendations that may contribute to Kazakhstan’s renewable energy targets.

Özet

Kazakistan, zengin fosil yakıt rezervlerine dayalı bir enerji ekonomisine sahip olmasına rağmen son yıllarda küresel iklim taahhütleri ve enerji güvenliği konularındaki gelişmeler doğrultusunda yenilenebilir enerji alanında kapsamlı bir politika ve mevzuat dönüşümü sürecine girmiştir. Bu çalışma, Kazakistan’ın “Yeşil Ekonomiye Geçiş” stratejisi çerçevesinde şekillenen yenilenebilir enerji mevzuatını ve bu düzenlemelerin enerji dönüşüm sürecindeki rolünü analiz etmektedir. Araştırmada politika analizi ve doküman incelemesi yöntemi kullanılarak yenilenebilir enerji alanındaki yasal düzenlemeler, politika araçları ve kurumsal uygulamalar değerlendirilmiştir. Çalışma kapsamında sabit alım tarifesi sisteminden rekabetçi ihale mekanizmasına geçişin hukuki ve ekonomik sonuçları ile uluslararası iş birliklerinin ulusal mevzuat üzerindeki etkileri incelenmiştir. Bulgular, Kazakistan’da yenilenebilir enerji yatırımlarını teşvik eden hukuki düzenlemelerin son yıllarda önemli ölçüde geliştiğini, ancak elektrik şebekesi altyapısındaki sınırlılıklar, finansman riskleri ve enerji sisteminin fosil yakıtlara dayalı yapısı gibi faktörlerin enerji dönüşüm sürecini zorlaştırdığını göstermektedir. Çalışma, mevcut yasal çerçevenin güçlendirilmesine yönelik regülatif iyileştirme alanlarını ortaya koyarak Kazakistan’ın yenilenebilir enerji hedeflerine ulaşmasına katkı sağlayabilecek politika önerileri sunmaktadır.
