Abstract

Sport is the subject of law and therefore also of criminal law. It is primarily a matter of protection against manipulation of sporting competition and doping. In 2017, two specific criminal provisions were introduced into the StGB: § Section 265c StGB = sports betting fraud and Section 265d StGB = manipulation of professional sports competitions. There is a fierce dispute as to what the protected legal interests are. The legislator says: "Sports betting fraud and manipulation of professional sports competitions impair the integrity of sports and fraudulently damage the assets of others. They undermine the credibility and authenticity of the sporting contest and thereby jeopardize the social and economic importance of sport." In criminal law literature in Germany, the question of protected legal interests is hotly debated. Back in 2015, the legislature enacted the Anti-Doping Act. Doping ranges from a state-organized doping system to doping in the body image scene. Here, too, the integrity of sport appears as a protective purpose. Here, too, there are doubts about its legitimacy. The integrity of sport - some believe in it, others doubt its protection by criminal law. This proves to this day the dubious legitimacy of the German criminal provisions for the protection of the "integrity of sport".
