Abstract
Current social and economic dynamics have paved the way for a structural transformation in traditional property crimes and, in particular, for a rapid increase in the frequency of fraud offenses. This quantitative increase makes it a dogmatic necessity for the state to effectively fulfill its positive obligation (status positivus) to protect individuals’ freedom of will and property values. The primary objective of this study is to evaluate the basic form of the crime of fraud, as regulated in Articles 157 and 158 of the Turkish Penal Code No. 5237, and the aggravating circumstances that enhance the unjust nature of the act, through a comprehensive approach centered on general principles of criminal law and current Supreme Court precedents. Within the scope of this analysis, the concept of “deception” —the constitutive material element of the crime—is first examined; it is argued that even simple deception must be deemed sufficient for the crime to be established, with the aim of preventing the loss of rights suffered by victims in vulnerable positions from resulting in “impunity.” Subsequently, the fine legal distinctions between aggravating factors—such as the exploitation of religious beliefs and sentiments listed exhaustively in the law, the use of the victim’s difficult circumstances or impaired cognitive capacity as a tool, the functional exploitation of public administration and financial institutions, or the direct infliction of harm—were analyzed in detail. In this context, the intersection of fraud and theft offenses through the distinction between absence of intent and weakness of intent, as well as classification issues regarding the initiation of execution acts (the attempt stage) in insurance fraud, have been examined. Consequently, the dogmatic shortcomings arising from forcing new-generation economic fraud schemes—which integrate modern communication technologies—and sui generis violations, such as pyramid schemes, into existing narrow legal frameworks have been highlighted; and, from a future law (de lege ferenda) perspective, structural reform proposals have been presented for the establishment of distinct criminal offenses that fully comply with the principle of legality in criminal law.
