Abstract
Article 158 of the Turkish Code of Obligations grants a final opportunity to a plaintiff who has resorted to legal means to obtain their claim but whose initial actiom has been dismissed due to procedural errors, provided that the statute of limitations or the period for forfeiture of rights has expired in the meantime, and in this case the plaintiff is granted an additional sixty-day period. This rule, which allows the plaintiff to bring the case before the court for a second time, is regarded as a requirement of the right for a fair trial. Therefore, in actions filed within this sixty-day additional period, defenses based on the statute of limitations or the forfeiture period will not be admissible. Legal doctrine and Court of Cassation precedents mostly state that the application of this provision is limited to the situations explicitly listed in the article. Furthermore for the plaintiff to benefit from the sixty-day additional period, the initial lawsuit must be dismissed solely on procedural grounds; however, it is generally accepted that this rule does not apply in cases where the lawsuit is deemed not to have been filed. Since there is no difference between them in terms of their legal nature and effect on the statute of limitations, the additional period must be granted not only in cases where the lawsuit is dismissed on procedural grounds due to a procedural error or deficiency, but also in cases where the lawsuit is deemed not to have been filed, as long as there is a correctable error.
