Abstract

Various approaches have been developed in constitutional theory to explain the concept of the nation, particularly the objective and subjective concepts of the nation. As one of the fundamental elements of the state, how the nation is defined within a constitutional framework and how its boundaries are drawn is of particular importance for practical issues such as the scope of political parties’ activities, legislative activities concerning crime and punishment, the regulation of the official language, the interpretation of the principle of secularism, and state–citizen relations. In this respect, the study aims to evaluate the place of the Turkish nation and related concepts, such as the notion of “Turk,” Atatürk's nationalism, and the indivisible integrity of the state, within constitutional theory, together with their interpretation in the case law of the Turkish Constitutional Court. The findings indicate that the Constitutional Court largely interprets the concept of the nation within the framework of the subjective concept of the nation. It defines the Turkish nation primarily on the basis of citizenship and adopts an inclusive and integrative approach. At the same time, the Court appears to adopt a more cautious stance with regard to the protection of the official language, the principle of secularism, and the indivisible integrity of the state with its territory and nation. Furthermore, the Turkish nation is understood not only as a legal and political unity but also as a social unity shaped by the geography of Anatolia, its historical background, and references to the collective will demonstrated during the Turkish War of Independence.
