Abstract
This study examines the contribution of the legal and political developments that occurred during the Constitutional Monarchy period, the final phase of the Ottoman Empire, to the development of democracy. To this end, the study first analyzes the concept of democracy and its legal and political characteristics and then examines the legal and political developments that took place during the First and Second Constitutional Eras, with a view to demonstrating their relationship to the concept of democracy. Since the First Constitutional Era lasted for only two years, its most significant development was the promulgation of the Kanun-i Esasi (the Ottoman Constitution of 1876). However, in its original form, the Kanun-i Esasi was far from being a democratic constitution. Sovereignty remained vested in the Sultan, who also exercised executive authority. Following the proclamation of the Second Constitutional Era, however, a series of constitutional amendments transformed the constitutional framework into a more democratic one, establishing the system as a “constitutional monarchy”. Despite these constitutional reforms, the Committee of Union and Progress, backed by the military, gradually consolidated its political power, and particularly after the 31 March Incident, the political system became increasingly authoritarian before ultimately evolving into a fully repressive regime after 1913.
