Abstract
This article examines the legitimacy of the compulsory share in inheritance law from a comparative and legal-policy perspective. Traditionally justified by family solidarity, preservation of family wealth, and the economic protection of close heirs, this basis has been significantly weakened by the family's transformation into a unit of consumption, the expansion of the welfare state, demographic change, and the strengthening of individual property rights. The study first analyzes the dogmatic structure of the compulsory share and reduction regime in Turkish law, then evaluates its practical functioning through disinheritance, favor testamenti, the distinction between sham transactions and reduction, and case law. The comparative analysis focuses on German, Swiss, Austrian, and English and Welsh law. The central argument is that complete abolition of the compulsory share would be inappropriate at present, but the current regime can no longer be preserved unchanged. The study concludes that its scope should be narrowed, descendants' protection reconsidered, the surviving spouse's protection strengthened, disinheritance grounds modernized, the reduction regime graduated, and favor testamenti given greater weight. It proposes reducing descendants' share to one third of their statutory entitlement, replacing parents' categorical share with a need-based claim, and adopting a ten-year graduated reduction for inter vivos gifts.
