Abstract
This article examines whether alimony for poverty (maintenance) agreed upon within the framework of a consensual divorce protocol may be terminated by the parties’ mutual and free will after the divorce judgment has become final. The study is grounded in the observation that, while Articles 175 and 176 of the Turkish Civil Code regulate the establishment, modification, and termination of alimony for poverty, they do not expressly address the possibility of termination based solely on the parties’ subsequent agreement. In this respect, the article focuses on the normative nature of this legislative silence and discusses whether it reflects a deliberate legislative choice or constitutes a genuine legal gap that requires completion through interpretation. The analysis is conducted in light of the voluntary character of consensual divorce and the principle of freedom of contract as reflected—albeit in a limited and exceptional manner—in family law. From this perspective, the article argues that excluding the parties’ will entirely at the stage of terminating alimony, despite the broad autonomy granted to them at the stage of its establishment, is neither normatively nor systematically consistent. Given that the consensual divorce protocol represents a contractual arrangement based on the parties’ free will, it is maintained that agreements concerning the continuation or termination of alimony should, under certain conditions, be capable of producing legal effects. Accordingly, the article concludes that the silence of Article 176 of the Turkish Civil Code regarding termination by agreement constitutes a genuine legal gap. It is further argued that this gap should be filled through systematic and teleological interpretation, as well as by reasoning based on the principle of a fortiori (evleviyet), in a manner that allows legal recognition of the parties’ mutual and free will, without undermining the protective function of family law.
