Abstract
The prohibition on recording and live-streaming sound and images during court hearings may, at first glance, appear to be an exception to the principle of openness. However, in fact, it does not constitute a limitation that negates this principle. On the contrary, the ban is a balancing mechanism designed to prevent conflicts with interests worthy of protection, such as personal rights, privacy, and the dignity of the hearings, when applying openness. In Turkish law, this ban is regulated in Article 153 of the Code of Civil Procedure No. 6100, and its application is extended to e-hearings via the Regulation on the Conduct of Hearings by Means of Audio and Video Transmission in Civil Proceedings. However, the digitisation of hearings has raised the question of the extent to which the prohibition can be effectively enforced in e-hearings. It is evident that while this prohibition can be monitored under the direct supervision of the judge in a physical courtroom, implementation difficulties arise in e-hearings due to the inability to control the environment in which participants are located and the structural susceptibility to third-party interference. With the proliferation of e-hearings, the risk of violation of this prohibition increases. This situation poses new risks in terms of the reliability of evidence, procedural safeguards for the parties, and the balance between openness and confidentiality. This study outlines the purpose, scope, and sanctions of the prohibition on audio and video recording and live-streaming under Article 153 of the Code of Civil Procedure and the relevant provisions of the Regulation. It critically assesses the effectiveness of the current regulation in light of monitoring difficulties and the security issues arising from the proliferation of e-hearings. In this context, it discusses whether the existing normative framework is adequate in the face of the risks posed by digital trial practices and substantiates the need for reform requiring explicit procedural safeguards at the legislative level.
