Abstract
In the last century, significant developments have occurred concerning the fundamental rights and freedoms of individuals. One of these is the recognition of the right to environment as a fundamental right and freedom. Indeed, this issue is regulated in the Article 56, Paragraph 1 of the 1982 Turkish Constitution, which states “Everyone has the right to live in a healthy and balanced environment”. In order to protect the right to the environment, some of the harmful acts against the environment must be penalized under criminal law. Article 1 of the Turkish Criminal Code No. 5237 (TCC) states that one of the purposes of the criminal code is to “protect public health and the environment”. Accordingly, the regulations between Article 181 and Article 184 of the TCC include some environmental crimes. However, it is a question how the environmental crimes under the environmental criminal law should be evaluated within the scope of the general provisions of the criminal law. One of these questions is how “Negligence”, which is one of the mens rea of the crime, manifests itself in terms of environmental crimes. In this study; it is evaluated how negligence, which is one of the mens rea of the crime, is generally defined; what environmental criminal law is; how negligence is characterised in terms of environmental criminal law and the environmental crime in the Turkish Criminal Code regarding negligence is explained.
