Abstract

This article examines the status of platform workers under Turkish labour law in light of Directive (EU) 2024/2831 and offers concrete reform proposals. In Türkiye, platform companies disguise de facto relationships of dependency through private law structures such as ordinary partnerships and work contract while the current legal framework lacks the tools to counter these practices. Classical criteria for dependency fail to capture algorithmic management; the burden of proof falls on the worker despite unequal access to information, and algorithmic decisions operate without any transparency obligation. Decisions of the Regional Courts of Appeal show the judiciary stretching existing tools to find solutions, yet the final nature of these decisions in reinstatement cases structurally prevents binding case law from forming at the Supreme Court level. Drawing on a comparative analysis of the German, Spanish, and Italian models, four reforms are proposed: establishing the concept of "quasi employees" in law; adding economic dependence as a criterion to Labour Law No. 4857; shifting the burden of proof to the platform; and incorporating an algorithmic transparency obligation into labour legislation. While inspired by the Directive's mechanisms, the proposals rest on an independent model adapted to Türkiye's specific legal conditions.

Özet

Bu makale, platform çalışanlarının Türk iş hukukundaki statüsünü Direktif (AB) 2024/2831 ışığında incelemekte ve somut reform önerileri sunmaktadır. Türkiye'de platform şirketleri, adi ortaklık ve eser sözleşmesi gibi özel hukuk kalıpları aracılığıyla fiilî bağımlılık ilişkisini gizlemekte; mevcut yasal çerçeve bu pratikleri bertaraf edecek normatif araçtan yoksundur. Bağımlılık unsurunun klasik ölçütleri algoritmik yönetimi kavramaya yetmemekte, ispat yükü bilgiye erişim dengesizliğini görmezden gelen biçimde çalışana bırakılmakta ve algoritmik kararlar herhangi bir şeffaflık yükümlülüğü olmaksızın işlemektedir. Bölge Adliye Mahkemeleri'nin kararları, yargının mevcut araçları zorlayarak çözüm aradığını göstermekte; ancak işe iade davalarında BAM kararlarının kesin niteliği Yargıtay düzeyinde bağlayıcı içtihat oluşumunu yapısal olarak engellemektedir. Almanya, İspanya ve İtalya modellerinin karşılaştırmalı analizi temelinde dört reform önerisi geliştirilmiştir: "işçi benzeri çalışan" kavramının yasal zemine oturtulması, ekonomik bağımlılık ölçütünün 4857 sayılı İş Kanunu'na eklenmesi, ispat yükünün platforma yüklenmesi ve algoritmik şeffaflık yükümlülüğünün iş mevzuatına kazandırılması. Öneriler, Direktif’in mekanizmalarından ilham almakla birlikte Türkiye'nin özgün hukuki koşullarına uyarlanmış bağımsız bir model üzerine inşa edilmiştir.
