Abstract
This opinion article evaluates the participation of resident physicians in surgical procedures in the operating room from legal and professional ethics perspectives. Although the involvement of resident physicians in operating room practice is an indispensable part of medical specialty training, such participation should be assessed together with patient safety, specialist supervision, team organization and professional competence. The article particularly discusses the limits of residents’ responsibility in surgical interventions requiring specialist knowledge and skills, the duty of active supervision by specialists, the sufficiency of telephone-based guidance during on-call conditions and the responsibility of healthcare institutions regarding service organization. In this context, the concepts of the principle of trust, guarantor duty, service fault and organizational fault are examined in relation to the responsibilities of resident physicians, specialist physicians, healthcare institutions and operating room nurses. The article argues that a reasonable and ethical balance must be established between the resident physician’s right to education and the patient’s right to safe healthcare. It also emphasizes that operating room nurses, while not assuming the role of medical decision-makers, have an important role in documentation, reporting and intra-team communication processes concerning patient safety. In conclusion, legal responsibility in the operating room should not be reduced solely to the individual who performs the procedure; rather, the organizational, supervisory and patient safety conditions under which the surgical service is provided should also be taken into account.
