AI InsightConclusion: The gap between the protective line of case law in general administrative services and the strict practice in security services stems from an inconsistent interpretation of the legal meaning of remission; this gap is criticized on the grounds of the culpability principle, proportionality, and the prohibition of discrimination; and a statutory duty of individualized assessment and graduated measures is proposed.

Abstract
Objective: This study aims to systematically present the legal and ethical framework governing the termination of civil service status due to psychiatric illness, particularly bipolar disorder, on the basis of the case law of the Turkish Council of State. Method: A case-law analysis method was employed. Twenty-seven decisions of the Council of State on this subject were classified by type of administrative act (deemed resignation, disciplinary sanction, loss of eligibility conditions, and loss of health requirements in security and transport services) and examined; the findings were evaluated together with the relevant medical, legal, and bioethical literature, including stigma, the prohibition of discrimination, and the duty of reasonable accommodation. Results: Law no. 657 on Civil Servants provides four principal mechanisms through which psychiatric illness may affect civil service status. The common principle emerging from the decisions examined is that, since bipolar disorder progresses through episodes and remissions, the administration may not treat acts performed during an episode as products of a sound will; a psychiatric examination establishing culpability at the time of the act is a precondition of any disciplinary sanction; and termination requires an official medical board report establishing that the illness permanently prevents the performance of duty. By contrast, in security and transport services, the Council of State upholds absolute bars based on past medical records in the name of service requirements. Conclusion: The gap between the protective line of case law in general administrative services and the strict practice in security services stems from an inconsistent interpretation of the legal meaning of remission; this gap is criticized on the grounds of the culpability principle, proportionality, and the prohibition of discrimination; and a statutory duty of individualized assessment and graduated measures is proposed.
Özet
Amaç: Bu çalışmanın amacı, psikiyatrik rahatsızlık, özellikle bipolar bozukluk tanısı nedeniyle Devlet memurluğu statüsünün sona ermesine ilişkin tesis edilen idari işlemlerin hukuki ve etik çerçevesini, Danıştay içtihadı üzerinden inceleyerek sistematik biçimde ortaya koymaktır. Yöntem: Çalışmada içtihat analizi yöntemi izlenmiştir. Danıştay’ın konuya ilişkin 27 kararı, işlem türlerine (müstafi sayılma, disiplin, şart kaybı, güvenlik ve ulaştırma hizmetlerinde sağlık şartı kaybı) göre sınıflandırılarak incelenmiş, bulgular ilgili tıbbi, hukuki ve biyoetik literatürle (damgalanma, ayrımcılık yasağı, makul uyumlaştırma yükümlülüğü) birlikte değerlendirilmiştir. Bulgular: 657 sayılı Devlet Memurları Kanunu, psikiyatrik rahatsızlığın memurluk statüsüne etki edebileceği başlıca dört mekanizma öngörmektedir. İncelenen kararlardan çıkan ortak ilke şudur: Bipolar bozukluk atak ve remisyon dönemleriyle seyreden bir hastalık olduğundan, idare, ilgilinin atak döneminde gerçekleştirdiği fiilleri sağlıklı bir iradenin ürünü sayarak işlem tesis edemez; disiplin cezası verilmeden önce fiil tarihindeki kusur yeteneğinin psikiyatrik muayeneyle tespiti zorunludur; göreve son verilebilmesi için hastalığın görevin devamlı yapılmasına engel nitelikte olduğunun resmî sağlık kurulu raporuyla saptanması gerekir. Buna karşılık güvenlik ve ulaştırma hizmetlerinde Danıştay, geçirilmiş hastalık kaydına dayalı mutlak engelleri hizmet gerekleri adına hukuka uygun bulmaktadır. Sonuç: Genel idare hizmetlerindeki koruyucu içtihat çizgisi ile güvenlik hizmetlerindeki katı uygulama arasındaki makas, remisyonun hukuki anlamının tutarsız biçimde yorumlanmasından kaynaklanmaktadır; bu makas, kusur ilkesi, ölçülülük ve ayrımcılık yasağı temelinde eleştirilmekte, kanuna yazılı bir araştırma ve kademelilik yükümlülüğü önerilmektedir.
