Abstract
The non-price factor method is a procurement evaluation method used to assess the most economically advantageous bid. This approach aims to ensure the effective and efficient use of scarce public resources by completing the procurement process with high quality and at the lowest possible cost over the long term. This study focuses on the legal and economic dimensions of the application of non-price factors in the Turkish procurement system and examines the impact of this application on public resources. In this context, documents obtained from the Electronic Public Procurement platform are analysed. The analysis focuses on the intensity and type of non-price factors used and their impact on the winning bid. The study concludes that the non-price criteria regulations contained in the General Communique on Public Procurement are contravene the hierarchy of norms, the purpose of non-price factor criteria, and the concept of public welfare. It has been determined that the impact of non-price factors used in service procurement and construction works in accordance with the circular is not concrete and measurable in terms of public benefit. Despite this, it has been observed that the lowest bid price is not preferred in approximately 10% of tenders. In this regard, it is considered that non-price criteria that do not provide concrete and measurable public benefits and do not offer additional contributions cause an unjustified decrease in public resources rather than public benefit.
