Abstract
The Constitution of the Turkish Republic of Northern Cyprus (TRNC) has received little attention in legal doctrine. As a natural consequence, the impact of the 1985 Constitution on society and the state remains largely unknown. In this study, decrees having the force of law, as regulated in Articles 112 and 128 of the TRNC Constitution, are examined using the norm analysis method. These decrees are generally referred to as “decrees having the force of law.” In the study, decrees having the force of law are evaluated in accordance with the theory of administrative act. Following this assessment, both the current status of decrees having the force of law and the manner in which these decrees could be structured through a future constitutional amendment are identified. The subject is examined within the framework of the TRNC system of government, and particular attention is also given to the regulatory powers of the executive branch.
