Abstract
In criminal procedure law, the principle of immediacy of evidence requires that the judge base their decision on evidence presented and directly evaluated during the trial. This principle reflects the aim of uncovering the truth and is particularly emphasized in relation to personal evidence. The reading of written documents during the hearing and their use as a basis for judgment is not an exception to the principle of immediacy but rather a complementary result of it. Although the Criminal Procedure Code recognizes the principle of free evaluation of evidence, it prioritizes personal evidence over material evidence and evidence presented during the trial over external sources. However, situations such as the inability to present a witness, co-defendant, or expert at the hearing constitute the main exceptions to this principle. These situations often arise from natural or factual impossibilities and carry the risk of evidence loss; therefore, they are considered in a limited manner within the framework of the principle of proportionality. The aim of this study is to examine the principle of immediacy of evidence in criminal procedure law from both conceptual and normative perspectives, and to evaluate its limitations and exceptions in practice. The study employs an interpretative and comparative methodology by analyzing doctrinal sources and legislative provisions in light of comparative legal systems and judicial precedents.
