Abstract
The increasing use of mobile phones as sources of evidence has created uncertainty in Turkish criminal procedure concerning the legal significance of consent to digital examination. This article examines whether the voluntary surrender of a mobile phone, disclosure of its password, or consent to the examination of its contents may substitute for the procedural safeguards governing digital searches under Article 134 of the Turkish Code of Criminal Procedure. Drawing on Turkish criminal-procedure scholarship, legislation, and the case law of the Court of Cassation and the Constitutional Court, the article distinguishes voluntary production of digital evidence from State-conducted investigative searches. It argues that consent may justify the disclosure of predetermined digital information but should not constitute an autonomous legal basis for law-enforcement authorities to search a device. To identify the boundary between these situations, the article proposes a four-factor test based on selection, control, scope, and technical intensity. The more evidentiary selection and control shift from the individual to investigative authorities, the broader the examination becomes, and the more technically intrusive the method employed, the stronger the conclusion that Article 134 safeguards are required. This framework seeks to preserve voluntary digital evidence production while preventing consent from circumventing statutory protections governing digital searches.
