Abstract
This study aims to examine the capacity of administrative judiciary in Turkey to protect human rights and the structural limitations that narrow this capacity. The main research question is what the limitations are in the practical protection of these rights by the Turkish administrative judiciary system, consisting of the Council of State and administrative courts, despite its potential defined by constitutional guaranties and international human rights norms. The study is based on the examination of the literature related to constitutional regulations, administrative law doctrine, and the case law of the European Court of Human Rights and the Constitutional Court using a descriptive-analytical method. The findings reveal that the capacity of the Turkish administrative judiciary to protect human rights is seriously limited in terms of accessibility, independence, and effectiveness. In terms of accessibility, the short duration for filing lawsuits and the high litigation costs effectively restrict the freedom to seek justice. In terms of independence, structural issues in the judicial appointment mechanisms are increasing executive influence. In terms of effectiveness, delays in judicial processes and disruptions in the implementation of decisions, combined with a lack of alignment with ECtHR case law, create a noticeable tension between the normative framework and judicial practice. The study proposes the implementation of constitutional reforms to strengthen judicial independence, the establishment of institutional mechanisms to monitor the execution of decisions, the consistent application of ECtHR case law in domestic law, and the institutionalization of human rights training programs for members of the judiciary.
