Abstract
Ethical principles in public services play a fundamental role in the reliability and effectiveness of the state. Public officials' adherence to ethical values is not only crucial for fulfilling their professional responsibilities but also for reinforcing public trust. Ethical violations should not be viewed as individual irresponsibility but as a significant issue that leads to a loss of societal trust. Disciplinary boards are the key mechanisms for overseeing whether public officials comply with ethical principles and for evaluating violations. The effective operation of these boards is critical for preventing ethical violations and applying necessary sanctions. However, certain provisions in Article 38 of the regulation concerning Law No. 5176 on the Establishment of the Public Officials Ethics Board and Amendments to Certain Laws create a situation that contradicts the relevant law and creates ambiguity in the duties of the disciplinary boards. In this critical review, it is emphasized that ethical complaints should be investigated by disciplinary superiors and examined by disciplinary boards, and it is suggested that the regulation in question be amended to eliminate its contradiction with the law.
