Abstract
Abstract Purpose: In order to determine the legal nature of liability for the resulting damage and to evaluate whether such damage falls within the scope of coverage of compulsory liability insurance, it is crucial to determine whether the motor vehicle was in a state of operation or not. Consequently, this study primarily aims to examine the liability of the motor vehicle operator by differentiating between cases in which the vehicle is classified as in a state of operation and those in which it is not, to determine the legal nature of liability arising from damage that may occur under differing factual circumstances, and to evaluate the matter from the perspective of insurability. Methodology: The study sets out findings and evaluations concerning the legal nature and the insurability of the operation of motor vehicles and concludes with an assessment of these findings in the light of judicial precedents. Findings: The conditions under which a motor vehicle operator is held liable for damage vary depending on whether the vehicle is considered to be in a state of operation or not, reflecting the differing legal nature of liability in each case. When the specific conditions giving rise to the liability of the motor vehicle operator are examined, it becomes evident that such conditions vary depending on whether the vehicle is in operation. In this context, differing views exist within legal doctrine regarding the legal nature of the liability in question. Whether the motor vehicle that caused the damage is in operation or not directly affects its insurability. Implications: The legal liability of the operator for damages resulting from the operation of a motor vehicle constitutes a form of strict liability based on danger. It is generally accepted that, even when the vehicle is not in a state of operation, if the fault of persons responsible for the operator’s actions or a defect in the vehicle contributes to an accident and the resulting damage, the operator bears strict liability arising from the failure to fulfill the duty of care. If the operator was at fault in the accident, liability is based on the principles of fault. Liability for damages resulting from a vehicle not in operation is excluded from the coverage provided by compulsory liability insurance (Clause A.6). This study aims to contribute to legal practitioners, persons who have suffered damage as a result of motor vehicles, and legal doctrine. Limitations: The subject matter of the study has aspects that concern multiple disciplines and various branches of law. The subject has been primarily examined within the scope of law of obligations. The insurance law aspect of the subject has contributed to evaluations regarding liability law, while the technical dimension of insurance beyond its legal aspect has been excluded from the scope of the study. Keywords: Motor vehicle operator liability, compulsory liability insurance, strict liability, operation of a motor vehicle. Jel Codes: K13, K12, G22.
Jel Kodu: K13, K12, G22.
