Abstract
The Ministry of Treasury and Finance has introduced the Organization-Supervised Analysis System (KURGAN), developed by the Tax Audit Board, as part of its Strategy to Combat Counterfeit Documents, marking the beginning of a new era. The system will be operational as of October 1, 2025. The KURGAN system aims to instantly detect counterfeit and risky transactions, protect the state’s tax revenues, and ensure tax justice. Through the system, transactions identified as risky are notified to taxpayers via a “KURGAN letter,” and an explanation is requested from the taxpayer. The study seeks to answer the question: “Can the request for clarification using the KURGAN letter be refused by invoking the nemo tenetur principle?”. The first section explains what the nemo tenetur principle is, along with decisions of the European Court of Human Rights and the Constitutional Court within the scope of the European Convention on Human Rights, the Constitution, and national legislation. The second section clarifies the meaning of the KURGAN system and why it was developed, examining the nature of the KURGAN letter. The final section discusses whether the recipient of the letter can refuse to provide the requested explanation by invoking the nemo tenetur principle within the scope of their rights and obligations.
