Abstract
This study examines the institution of recidivism in Turkish criminal law and the Three Strikes laws in the United States from a comparative law perspective with particular regard to the legal consequences attached to repeat offending. First, the study analyzes the legal nature, conditions of application, and consequences of recidivism under Article 58 of the Turkish Penal Code, arguing that the institution functions not as a sentencing enhancement mechanism but rather as institution of execution law involving a special execution regime for repeat offenders and post-release supervision measures. In this context, debates concerning recidivism within substantive criminal law, enforcement law, and the theory of security measures are evaluated, and its position within the Turkish criminal justice system is examined. Subsequently, the historical development, criminological foundations, and normative structure of the Three Strikes laws are analyzed with particular reference to the Washington and California models. The study further explores the role of selective incapacitation and criminal career theories in shaping repeat offender policies and comparatively evaluates both institutions in terms of their legal nature, conditions of application, and legal consequences.
Özet
Bu çalışmada, mükerrer suçluluğa bağlanan hukuki sonuçlar bakımından Türk ceza hukukundaki tekerrür kurumu ile Amerika Birleşik Devletleri hukukunda uygulanan Three Strikes yasaları karşılaştırmalı hukuk perspektifiyle incelenmiştir. Çalışmada öncelikle 5237 sayılı Türk Ceza Kanunu’nda düzenlenen tekerrür kurumunun hukuki niteliği, uygulanma şartları ve sonuçları ele alınmış; kurumun ceza artırımı sebebi olmaktan ziyade mükerrirlere özgü infaz rejimi ve infaz sonrası denetim mekanizmaları öngören infaz hukukuna özgü bir müessese niteliği taşıdığı ortaya konulmuştur. Bu kapsamda tekerrürün maddi ceza hukuku, infaz hukuku ve güvenlik tedbirleri teorisi bakımından doğurduğu tartışmalar değerlendirilmiş; kurumun Türk ceza hukuku sistematiği içerisindeki yeri incelenmiştir. Devamında Washington ve Kaliforniya eyaletleri esas alınarak Three Strikes yasalarının tarihsel gelişimi, kriminolojik temelleri ve normatif yapısı değerlendirilmiştir. Bu çerçevede mükerrer suçluluğa ilişkin düzenlemelerin suçun önlenmesi, kamu güvenliğinin sağlanması ve tehlikeli suçluların toplumdan uzaklaştırılması bakımından üstlendikleri işlevler incelenmiş; seçici etkisizleştirme (selective incapacitation) ve suç kariyeri (criminal career) teorilerinin sistem üzerindeki etkileri ele alınmıştır. Son olarak her iki kurum, hukuki niteliği, uygulanma şartları ve doğurduğu sonuçlar bakımından mukayeseli olarak değerlendirilerek, farklı ceza siyaseti anlayışlarının mükerrer suçluluğa yaklaşımı ortaya konulmuştur.
