Abstract
The search for solutions to the global climate crisis has prompted states to adopt environmentally friendly choices in their economic policies. Conducting public procurements in accordance with environmental criteria constitutes a typical example of this trend. Green public procurement criteria, which can be regarded as an extension of the “green budget” approach and as a requirement of the social state principle, may be incorporated at all stages of public procurement processes, from the preparatory phase of the tender to the post-contractual phase. Although the significance of green public procurement is emphasized in the European Union directives, an adequate legal infrastructure has yet to be established in Türkiye. Nevertheless, it is anticipated that concrete steps will be taken in the near future with respect to such public procurements, both to fulfill international commitments and to implement national action plans. In order for green public procurement to be carried out in compliance with the law, it must be implemented in a manner consistent with the fundamental principles governing public procurements. As indicated in the case law of the Court of Justice of the European Union, in order to ensure compliance with the principles of equality, non-discrimination, the economically most advantageous offer, competition, and transparency, it is necessary to provide clear and optional environmental criteria and to adopt life-cycle costing in the relevant analyses. Appropriate legal regulations should therefore be introduced to facilitate these practices. In the initial phase of implementing green public procurement, it would also be beneficial to begin with specific sectors rather than applying a universally binding approach and to grant contracting authorities a margin of discretion before making these practices compulsory.
