Abstract
Damages caused by uninsured vehicles, the bankruptcy of insurance companies, or the revocation of their operating licenses reveal risk areas that remain outside the protection of the insurance system with regard to injured third parties. In such situations, the Assurance Account (Güvence Hesabı) plays a crucial role as a guarantee mechanism that complements the compulsory insurance system and enables injured parties to obtain compensation under certain conditions. At the same time, the institution functions as a complementary fund mechanism designed to address deficiencies in the compulsory insurance system and strengthen the protection of victims. In this respect, the Assurance Account represents an institutional structure that reinforces the social protection function of the insurance system and fills practical gaps arising when compulsory insurance fails to operate effectively. The main motivation of this study is to examine the legal and fiqh (Islamic jurisprudential) dimensions of the Assurance Account together, given its role in compensating losses in cases where the compulsory insurance system cannot fully fulfill its function. Accordingly, the study adopts a holistic approach that evaluates the institution both within the framework of positive law and in light of participation finance principles. The first part of the study analyzes the Assurance Account from a legal perspective within the framework of the current legislation. In this context, the revenue and expenditure items of the Account, the conditions for application, the scope of compensation, payment procedures, and the management of its assets are examined. Particular attention is paid to its relationship with compulsory insurance, the distinction between bodily and material damages, the recourse mechanism, and the regulations governing the financing structure of the fund. The study also evaluates the complementary function of the Account within the compulsory insurance system and its role in protecting injured third parties. The mechanism becomes operative in cases such as damages caused by uninsured vehicles, the bankruptcy of insurance companies, or the revocation of their licenses. In this regard, the Assurance Account is demonstrated to be not merely a technical insurance institution but also a public risk-sharing mechanism aimed at protecting victims. By analyzing the legal foundations, operational procedures, and practical functioning of the institution, the study clarifies its position within the overall structure of the compulsory insurance system. The second part examines the Assurance Account in terms of participation finance principles. Within this framework, the fiqh nature of the institution and its place within broader debates on insurance are evaluated. The sources of revenue, the investment of funds, and the compatibility of existing practices with participation-based insurance regulations are analyzed. The study particularly focuses on principles such as fund management, the prohibition of interest, and risk sharing. Issues such as the selection of investment instruments and the methods used for the collection of receivables are assessed in light of the fundamental principles of Islamic law. In addition, the legitimacy of the financial instruments used in fund management and their potential compatibility with participation-based financial instruments are discussed. Overall, the study aims to provide a comprehensive evaluation of the Assurance Account from the perspectives of both positive law and Islamic law. Based on the findings, the study proposes improvements aimed at balancing legal effectiveness with fiqh compliance, addressing theoretical and practical shortcomings, and enhancing the compatibility of the system with a participation-based model. Thus, it contributes both to the assessment of the current structure of the Assurance Account and to the development of a guarantee mechanism more consistent with participation finance principles.
