Abstract
After it was understood that the rules which will carry individuals, and therefore societies, to the ideal of living together in prosperity and peace, have their origins in human rights law, the international community has moved on to the stages of determining, introducing, implementing, and watch on these rules. The European Convention of Human Rights (ECoHR) accepted by the countries of the Council of Europe and the European Court of Human Rights (ECrHR) established by this convention has shown great success in realizing this ideal. In the first part of the review, after focusing on the term of human rights, brief information about the process of taking place in positive law under the concept of fundamental rights and freedoms is presented. Although the ECoHR forms the basis of the system of protection of fundamental rights and freedoms established within the framework of the Council of Europe, sixteen protocols have been attached to this convention over time. Due to these additions, it is difficult to access the rights determined by the contract and additional protocols from a single source. In order to overcome this difficulty, in the second part of the study, all the rights within the scope of the ECHR have been compiled and presented with their primary sources. Subsequently, the effects of the Convention and the Court's decisions on Turkish domestic law and the expanding character of human rights in terms of quantity and quality are emphasized. The focus of the study is ECoHR art. 8 ‘Respect for Private and Family Life’ principle. The way this right has been interpreted by the ECrHR from past to present has been presented in the light of recent decisions. Bireyleri, dolayısıyla toplumları refah ve barış içinde birlikte yaşama idealine taşıyacak kuralların insan hakları hukukundan kaynağını aldığı anlaşıldıktan sonra, uluslararası toplum bu kuralların belirlenmesi, tanıtılması, uygulanması ve takibi aşamalarına geçmiştir. Avrupa Konseyi ülkeleri tarafından kabul edilen İnsan Haklarını ve Ana Hürriyetleri Korumaya Dair Sözleşme (AİHS) ve Sözleşme ile kurulan Avrupa İnsan Hakları Mahkemesi (AİHM) bu ideale ulaşma yönünde üstün bir başarı sergilemiştir. İncelemenin ilk bölümünde, insan hakları olgusunun terim karşılığı üzerinde durulduktan sonra temel hak ve özgürlükler konsepti altında pozitif hukukta yer alması süreciyle ilgili kısa bilgi sunulmaktadır. Avrupa Konseyi çerçevesinde oluşturulan temel hak ve özgürlükleri koruma sisteminin temelini AİHS oluşturmakla birlikte bu sözleşmeye zaman içinde onaltı protokol eklemlenmiştir. Çalışmanın odak konusunu AİHS md. 8 ‘Özel ve Aile Hayatına Saygı’ ilkesi oluşturmaktadır. Bu hakkın geçmişten günümüze AİHM tarafından yorumlanış şekli güncel örnek kararlar ışığında verilmektedir. İncelemenin sonuç bölümünde genel değerlendirmeyle birlikte insan haklarının korunmasında kilit rol oynayan yargının bağımsızlığı ve tarafsızlığı kadar önemli olan ‘yargının etkinliği’ olgusuna vurgu yapılmaktadır.
