Abstract

This academic article examines the central and determining role played by the Principle of the Child's Best Interest in the institution of the removal of guardianship, regulated under the Turkish Civil Code (TMK) as the most severe protective measure. Guardianship is accepted in modern law not as a right of parental sovereignty but as a fundamental obligation aiming at the child's protection and related to public order. The Child's Best Interest principle is the foundational tenet that limits the scope of guardianship and provides the legal basis for all necessary intervention measures. The removal of guardianship, stipulated in TMK art. 348, is not intended to punish the parent; rather, it seeks to protect the child from dangers such as neglect, abuse, illness, or inexperience. Consistent with this protective aim, guardianship can be removed regardless of parental fault if the duties of guardianship cannot be properly fulfilled. In the judge's decision-making process, the child's interest must absolutely prevail when it conflicts with the parents' interests. Decisions must be implemented within the framework of proportionality and commensurability, always as a last resort (ultima ratio). Furthermore, obtaining the views of the child who has reached a sufficient age of discernment and supporting decisions with expert opinions such as pedagogues or psychologists is vital for the complete determination of the child's best interest. Despite the removal of guardianship, the obligation for child support and the right of personal relationship continue, as the legal bond persists, unless contrary to the child's best interest. The article highlights practical problems and emphasizes the necessity of meticulous investigation for this crucial protective measure to achieve its purpose.
