Abstract

Cargo claims arising from carrier’s liabilities is a fundamental yet challenging issue in the sea-borne trade industry. Determining the proximate cause of a loss is, in particular, a complex issue. It has remained a central subject, particularly after the recent UK Supreme Court decision in the Volcafe case where the burden of proof and implementing a sound system in cargo claims were reassessed. The carrier’s fundamental duties under the Hague-Visby Rules are to provide a seaworthy ship and to take care of the cargo. Thus, the second base obligation of the carrier is to “properly” and “carefully” take care of the cargo under Article III Rule 2 of Hague-Visby Rules explained with a sound system in the landmark cases. This article reviews the carrier’s essential liabilities in accordance with the relevant international rules. This article also focuses on recent case law in comparison with earlier cases.
