Abstract
The aim of this research is to figure out how the police take the surveillance juvenile offenders under; and how surveillance process from police station to the court from the children rights perspective is. Research sampling included police officers working in police stations and the child bureau in Ankara. So, 193 police officers were interviewed. Furthermore, observations on three children in order to examine and understand the police custody process of the child closely were made. According to the findings, police officers put handcuffs on juveniles; if there is risk for running away and they give information about children to their families. But these findings do not coincide with observations in police station which was made by the researcher. As a conclusion; although there are some good developments such as child bureau, there are still problematic situations in the surveillance process. So it can be suggested that police officers in the police stations should be more sensitive to the children's rights.

Bu araştırmada çocuk haklan perspektifine dayalı olarak suça yönelen çocuk-polis ilişkisini özellikle gözaltı sürecinin nasıl işletildiğini ortaya çıkarmak amaçlanmıştır. Araştırmanın örneklemi Ankara ili kapsamında çalışan karakol ve çocuk şubesi polislerini kapsamaktadır. Araştırmada karakollarda çalışan polisler için tabakalı eşit küme örneklemesi yapılmıştır. Çocuk şubesinde çalışan polisler için tamsayım uygulanmıştır. Böylece 193 polise görüşme formu uygulanmıştır. Bunun yanı sıra araştırma süresince bir çocuğun karakoldan savcılık aşamasına kadar gözaltı süreci izlenmiş, iki çocuğun da çocuk şubesinden itibaren gözaltı süreci izlenmiştir. Araştırmada çocuklara kelepçe takılması zorunlu hallerde yapıldığı ve polislerin çoğunluğunun çocukların ailelerine haber verdiklerini belirtmişlerdir. Ancak karakol gözlemlerinde çocuklara karakollarda kelepçe takıldığı, çocukların ailelerine çocuk savcılığa çıkarken haber verildiği gözlenmiştir. Yine susma hakkının çocuğun suçun oluştuğu mekâna götürülmesi nedeniyle sağlanamadığı görülmektedir. Sonuç olarak çocuk şubesinin kurulması ile bir takım olumlu gelişmeler görülmesine rağmen karakol süreçlerinin problemliolduğu ve karakol polislerinin çocuk haklarına duyarlılığının arttırılması gerektiği söylenebilir.
