Abstract

In the beginning of 1960's when administrative reform transfers were intensified, under the leadership of State Planning Organization, public organizations in Turkey decided on public policies and public investments on the basis of evaluation criteria such as equality, productivity, and viability. In line with the dissemination of new public management (NPM) concepts and procedures in 2000's, these principles were replaced by new decision criteria known in the literature as 3e's (economy, efficiency and effectiveness). These new criteria took their place in many legal regulations, which define the organization and functioning of Turkish administration with the will of the political power and with the technical support of the European Union. This study discusses to what extent the Counsil of State reflects criteria specific to NPM to its decision by reviewing decisions of the Counsil of State. The study seeks to clarify how the paradigmatic difference between the principles of conventional administrative law doctrine such as equality, the supremacy of law and the economically based principles of NPM such as economy and efficiency are resolved in Turkish administrative law.
